SCIAHK has been reaffirmed as one of the qualified arbitral and dispute resolution institutions of the Arrangement Concerning Mutual Assistance in Court-ordered Interim Measures in Aid of Arbitral Pro

 

     On 2 April 2025, the Department of Justice (DoJ) of the Hong Kong Special Administrative Region (HKSAR) announced the updated list of qualified arbitral and dispute resolution institutions and permanent offices under Article 2(1) of the Arrangement Concerning Mutual Assistance in Court-ordered Interim Measures in Aid of Arbitral Proceedings by the Courts of the Mainland and of the HKSAR (hereinafter referred to as “Arrangement”). SCIAHK has been reaffirmed as a qualified arbitral and dispute resolution institution. It will be valid for a period of two years from the date of designation 2 April 2025, ending on 1 April 2027.

 

     According to the Arrangement, if the arbitral proceedings are seated in Hong Kong and administered by a designated arbitral institution (e.g., SCIAHK), before the arbitral award is made, each party to the arbitral proceedings may apply for interim measures from the relevant judicial authorities in Mainland courts. Applications for interim measures must include the arbitration agreement, relevant documents issued by the institution, and any other necessary materials. As a qualified institution, SCIAHK will cooperate throughout the process and assist the parties in handling the required materials to ensure compliance with the procedures and a smooth process.

 

     As the first independent arbitration institution established by a mainland arbitration institution in Hong Kong, since its establishment, SCIAHK has actively promoting the implementation and application of the Arrangement, assisted parties in preparing preservation materials, issued required documents, and maintained communications with Mainland courts in professional way. The successful implementation of the Arrangement not only solidified SCIAHK’s position but also provided a model for parties to follow when applying for the interim measures under the Arrangement in the future.
